Requests for information under GDPR, FOI and EIR

The General Data Protection Regulation 2018 (GDPR) allows you to find out what information is held about you, on paper and computer records. This is known as ‘right of subject access’ and applies to your Advance records, along with all other personal records.

You are entitled to receive a copy of your records free of charge, within a month. In certain circumstances access to your records may be limited, for example, if the records you have asked for contain information relating to another person.

The Freedom of Information Act (2000) (FOI) and Environmental Information Regulations (EIR) provide public access to information held by public authorities. You can ask for information including information held on computers, in emails and in printed or handwritten documents as well as images, video and audio recordings.

The Act does not give people access to their own personal data (information about themselves). If a member of the public wants to see information that a public authority holds about them, they should make a data protection subject access request, please see section above.

All requests for information should be in writing and contain as much information as possible to enable us to supply you with the precise details needed.   Some information may not be given to you because it is exempt, for example, because it would reveal personal details about someone else.


For your request to be dealt with according to the Freedom of Information Act you must put your request in writing in a letter or an email.  However, you can make a verbal or written request for environmental information.   Please include your name and contact details.  You do not need to give a reason.

We will supply information, wherever possible, and do so within 20 working days of you making the request.    We will supply all requested information, unless it falls within an exemption in the act. If a fee is payable, you will be notified in advance.


The Freedom of Information Act recognises that there will be valid reasons why some kinds of information may be withheld, such as if its release would prejudice national security or damage commercial interests. For some exemptions the public authority must consider whether the public interest in withholding the information outweighs the public interest in releasing it. If it decides that the information cannot be released it must tell you and explain why. Public authorities are not obliged to deal with vexatious or repeated requests or in some cases if the cost exceeds an appropriate limit.   More information on the exemptions can be found on the Information Commissioner’s Office (ICO) website at www.ico.org.uk.


We may also need additional time to gather the information you are requesting.  We will tell you if this is the case.


We will keep all personal data provided to us on the submission of your request safe, accessible by those who require it to provide this service to you and retain all FoI requests in line with our records retention schedules.
